Summary of Essential Facts: |     * In 1955, Mr. and Mrs. Briggs bought a home for $11,600, in Levittown,PA   * They made a $100down payment and borrowed $11,500 with a 30-year mortgage requiring payments of $82/month   * In late 1961, the Briggs were in financial difficulty, were unable to pay the mortgage and other home-related expenses and they moved out of the house   * At this time the Broggs and sacketts entered into an oral agreement based on which the Sacketts movedinto the Briggs’ house and paid the three months of delinquent payments due on the Briggs’ mortgage   * The Sacketts also agreed to make future payments on the mortgage   * No writing documents were ever executed regarding this arrangement   * The Sacketts continued to live in the house making the monthly mortgage payments an paying all other expenses relating to the property from 1961through 1976   * In 1976, Mr. Briggs filed a lawsuit seeking to evict the Sacketts from his house     * The Sacketts filed a counterclaim seeking to enforce the terms of their oral agreement under which they claim they purchased the house in 196212 |
