It is certainly understandable that the citizens of Seaboyer would be concerned with prostitution and its effect on their municipality as a whole.   It is therefore, also certain that they would be applying pressure on the municipal government to find ways in which they can stop prostitution related acts from occurring. While the bylaw that has been implemented by the newly elected town councillors of the city of Seaboyer may be an effective way to curb prostitution related activities, it is not, for several reasons, legal for them to impose such restrictions, and for these same reasons would provide the legal basis for citizens of Seaboyer to challenge the new bylaw.
First and foremost, not allowing groups of two or more individuals to assemble on city streets and sidewalks, regardless of what time, is taking away their fundamental freedoms of peaceful assembly, as well as their freedom of association.   “The freedom of assembly, sometimes used interchangeably with the freedom of association is the individual right to come together and collectively express, promote, pursue, and defend common interests” (http://en.wikipedia.org/wiki/Freedom_of_assembly). The Charter of Rights and Freedoms is part of the Constitution and therefore any law that is inconsistent with it is deemed to have no force or effect.   Citizens who are opposed to the bylaw could simply state that the disregard for their fundamental freedoms of peaceful assembly and association is reason enough for such a bylaw to be challenged and overturned.
Secondly, in Canada, it is not a crime to arrange to buy sex or to communicate about buying sex unless it is done or attempted in a public place.   If this act does occur in public, then it is deemed to be a criminal offence.   Criminal offences, as seen on page 13 of the course textbook fall under Federal jurisdiction.
